Background: Alien, a native of El Salvador, petitioned for review of the decision of the BIA, denying his application for asylum, withholding of removal, and relief under the Convention Against Torture (CAT).

Holding: The Court of Appeals held that BIA was required to consider alien's claim that he was deprived of his right to counsel in his hearing before the immigration judge (IJ), rather than summarily affirm the IJ's decision.
